Although we believe that the answers that we have provided are correct, our answer may deviate from what the Exam Committee expects. Also, the answers as shown on the blog are not 100% complete: we skipped many "easy steps" that actually will get "easy marks" for reasons of conciseness. We would expect the DI as posted to score 36-39 marks out of 40, and the DII as posted around 40-50 marks out of 60 (corresponding to 50-58 marks when including the "easy marks" for steps not explicitly indicated). So, when comparing (what you memorize of) your answer with our answers and conclude where you passed, failed or are around the pass/compensable fail/fail level, take some safety margin ;-)

All blog threads allow anyone to add comments and already have a lot of valuable, interesting and sometimes surprising discussions between many candidates who posted their comments as well as tutors resulted from those.
Any remarks, (different) opinions and questions as are welcome! Please post your contribution as comments to this blog, so everybody can paticipate in and benefit from the discussion/ explanation.

Please do not post your comments anonymously - it is allowed, but it makes responding more difficult and rather clumsy ("Dear Mr/Mrs/Ms Anonymous of 24-02-2014 17:54"), whereas using your real name or even a pseudonym (nick-name) is more personal, more interesting and makes a more attractive conversation.

Be reminded that the task in DI is to show to the Exam Committee that you understand the law and can apply the law. The law tested is the EPC, the PCT, the Paris Convention, decisions and opinions of the Enlarged Board of Appeal (G-decisions as well as R-decisions on petitions for review), landmark decisions of the Technical and Legal Boards of Appeal (T- and J-decisions), a general knowledge of the national laws of the EPC Contracting States "to the extend that they apply to European patent applications and European patents" and of the US and Japan.
Hereto, you need to give an answer supported by an explicit, step-by-step reasoning, wherein each step cites one or more specific legal provision or other reference, such as an OJ EPO publication.

Be reminded that the task in DII is to advise the client how to build and use a patent portfolio to support his business and to advise the client how to deal with third party’s rights that may prevent him from doing his business. It is thus not sufficient to only use legal patent terms (prosecute, infringe, within scope): you need use real life words that a real life client can understand (you will have protection for R, so you can stop your competiror from making/selling/using/importing ... in FR; your competitor has protection for S, so you can be stopped from producing ... in CZ).

Where we give legal basis, this is for information only - legal basis is not required in the DII-part.

D2014: First impressions?

To all who sat the D-paper today:

What are your first impressions to this year's D-paper? Any general or specific comments?

Were the topics well balanced in the DI-part?
Were the DI Questions difficult?
Did you skip any DI-questions?
 
Were the legal issues in the DII-part well doable? Did any error on one of the legal issues not have a big knock-on effect on the rest of the paper (D2013 was very well designed in this respect!)?
 
How much time did you allocate for DI, how much for DII? Which part did you do first, DI or DII?
How many marks do you expect to have scored in the DI-part, in the DII-part, overall?
Was the D-paper more difficult than the first 5-hour D-paper, the D 2013? What is your expectation of the pass rate and the average score?

Good luck at the EQE!!!

We wish all EQE 2014 candidates good luck at the EQE the coming week.

Make sure to score 45 marks or more to get at least a compensable fail, but preferably 50 or more for each main exam paper you are sitting (and over 70 for the pre-exam)! However, passing some papers and failing others is also OK, and is actually quite common ;-) so you need not at all feel bad if you do not pass all of them in one go.

If you did not yet sit all papers, or (expect to) fail one or more this year, please feel invited to check out our Main Exam training program starting as from May with Advanced D Legal Training (in NL only) and with Methodology Courses for all papers as from September at course locations all across Europe, as well as Guided Exam courses in December/January and our correction paper program for all papers.

If, while doing paper D, you found out that your Basic Legal knowledge was not at the required level yet, we also offer an 8-day Basic Legal Training (in 3 blocks of 4, 2 and 2 days) at our course venue in Eindhoven (NL). This 8-day, 3-block course is scheduled twice: a first course group starting in late March (21/3-3/4, 2-3/6 and 8-9/9) to allow main exam 2015 candidates to complete the Basic Legal Course before enrolling in the main exam methodology courses, and a second course group starting in September (15-18/9, 3-4/11, 15-16/12) to allow pre-exam 2015 candidates to do a complete legal training starting only after summer.

The Exam Secretariat announced the dates and times of the exam papers of EQE 2015, 2016 and 2017
EQE 2015: 23.02.2015 – 26.02.2015

EQE 2016: 29.02.2016 – 03.03.2016

EQE 2017: 06.03.2017 – 09.03.2017
The Pre-Exam is on Mondays, 13:00 – 17:00
The D-paper is on Tuesdays, 9:30 – 14:30
The A-papers are on Wednesday, 9:30 – 13:00
The B-papers are on Wednesdays, 14:30 – 17:30
The C-papers are on Thursdays, 9:30 – 14:30
Times indicated are Munich/ The Hague time. Helsinki and Bristol times are plus/minus one hour different.

Correction paper program for paper D EQE2014 extended

The regular hand-in deadlines for our paper D correction paper program have all expired, but we are glad to announce that we accept further correction papers until about Feb 15.

Five exams are available for paper D: the D2009-D2012 papers, all adapted by us to match the current 5-hour single-paper D format, and the D2013. Upon registration for one or more correction papers, we provide our version of the respecvtive paper(s). We correct and give individual feedback to your answer. We also provide our own detailed marking sheets and model solutions to help identify areas of weakness, and to give an idea of -and improve- EQE readiness.

In view of the short time left until "Paper D-Day", we aim to provide our marking and feedback within 3 working days after receiving your answer paper.
